Agreement

Plantywise is operated by Sebastian Schaaf. By accessing or using Plantywise, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

The service

Plantywise is a digital subscription service that provides AI-powered plant care guidance. Subscribers can chat with an AI assistant to receive plant identification, care advice, pest diagnosis, and other plant-related information. The service is delivered entirely online.

Licence

We grant you a limited, non-exclusive, non-transferable, revocable right to access and use Plantywise within the scope of your active subscription plan. You may not sublicence, resell, or redistribute access to the service.

Acceptable use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws.
• Engage in fraud, spam, or any deceptive activity.
• Infringe on any intellectual property rights.
• Interfere with the security or operation of the service, including distributing malware, probing vulnerabilities, or scraping data.
• Reverse-engineer, decompile, or attempt to extract the source code of the service.
• Circumvent any technical limitations or access controls.

AI-generated content

Plantywise uses artificial intelligence to provide plant care guidance. AI outputs may occasionally be inaccurate or incomplete. The service is not a substitute for professional horticultural, agricultural, or medical advice. You are responsible for how you use the information provided and should verify any critical guidance independently.

Account responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it updated.

Intellectual property

All rights, title, and interest in Plantywise — including software, design, branding, and documentation — remain the property of Sebastian Schaaf. Nothing in these terms transfers ownership of any intellectual property to you.

Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Service availability

We strive to keep Plantywise available and reliable, but we do not guarantee uninterrupted or error-free performance. The service may be temporarily unavailable for maintenance, updates, or reasons beyond our control.

Suspension and termination

We may suspend or terminate your access to Plantywise if you materially breach these terms, fail to pay, pose a security or fraud risk, or repeatedly violate our policies. Upon termination, your right to use the service ceases immediately.

Limitation of liability

To the fullest extent permitted by law, Sebastian Schaaf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total aggregate liability is limited to the fees you paid in the twelve months preceding the claim.

Disclaimer

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated through the service. Continued use after changes constitutes acceptance of the updated terms.
